We were delighted to attend this year’s AvMA (Action Against Medical Accidents) Conference, held at the impressive Royal Armouries Museum in Leeds – and what an event it turned out to be.

Mark Rayner and Ghazala Aziz represented Prosperity Insurance at the exhibition, and it’s fair to say the two days kept them very busy. With over 400 attendees from across the UK’s medical negligence and legal industry, the conference was a fantastic gathering of professionals, and this year’s focus on neurological conditions made for a particularly thought-provoking programme.

A brilliant venue

The Royal Armouries Museum proved to be an outstanding setting for the conference. As a venue for exhibitors, it struck the right balance: impressive and memorable, excellent space for presentations, and an exhibition space that allowed everyone to engage and network.

From the moment the doors opened, Mark and Ghazala were kept busy at all intervals – discussing insurance needs and getting to know firms of all shapes and sizes. Over 60 business cards were handed out across the event, which reflects just how many great conversations were had.

Spike steals the show

For those who’ve met us at events before, you’ll know that Spike (Prosperity’s beloved hedgehog mascot) tends to generate quite a bit of excitement. This year, we brought along a supply of Spike cuddly toys to give away from the stand, and we’re pleased (and perhaps slightly surprised) to report that our entire stock was gone well before the conference wrapped up. It seems Spike has fans across the UK’s medical negligence industry!

Prize draw winners

We also ran two prize draws across the conference days, with a pair of wireless earbuds up for grabs each time. A huge congratulations to our winners – Laura Sparrow from Specters Solicitors and Charlotte Rampley from Taylor Emmet Solicitors.

Prosperity Insurance is pleased to welcome Emma Hall, the newest addition to our legal team. Joining us as a Paralegal, Emma will be working across our After the Event (ATE) insurance offering, supporting both colleagues and clients as we continue to expand and tailor our services for law firms and those they represent.

Emma studied law before beginning her career in the insurance sector, joining a leading provider of healthcare insurance following her graduation. Her move to Prosperity marks a shift into legal insurance, nicely knitting together her legal background with her experience in the wider insurance market.

The role here at Prosperity, has also brought Emma to a new city. Having previously lived in her home town of Sheffield, she has since relocated to Manchester, where our team is based – and we’re delighted to see her settling in. Although she has only been with Prosperity for a short time, Emma has already become involved in several aspects of the business. Over the past few weeks, she has undertaken training, handled client and new customer matters, helping to ensure enquiries are handled efficiently and policies are put in place smoothly.

Emma has also supported the team in the development of new insurance policies, giving her an early opportunity to see the mechanics behind what we do. From understanding the structure of ATE policies to learning how coverage is tailored to different legal matters, she has been gaining insight into the full lifecycle of the products we provide – and why it differs from many of our competitors.

Outside of work, Emma still spends time visiting her home city of Sheffield, where she enjoys getting outdoors for long walks with her dog. She is also a self-confessed cinephile and enjoys catching the latest releases whenever she finds the time.

Emma’s legal background and growing experience within the insurance sector make her a valuable addition to the team. We thoroughly hope the team has provided you with the warmest of welcomes, Emma, and we look forward to seeing you continue to develop in your new role!

As a law firm, there are lots of circumstances where your client might need Unoccupied Property Insurance. But perhaps the most common is during probate. Administering a loved one’s estate is rarely straightforward. Alongside the legal responsibilities, Executors are often left managing practical issues they may have little experience with – and an unoccupied property is one good example.

The Winter season is a period of heightened risk for vacant homes. Falling temperatures and reduced ventilation significantly increase the likelihood of burst pipes, water damage, and other issues that can quickly escalate into significant repair costs. For estates and their executors, incidents like these can delay property sales, reduce asset value, and introduce unexpected expense at an already difficult time.

The challenges Executors and law firms face

Despite these risks, securing appropriate unoccupied property insurance is often more complicated than it needs to be. When arranging cover for a vacant property, law firms and their clients regularly encounter the same obstacles:

  • Limited knowledge about the property, making it difficult to answer detailed insurer questions.
  • Lengthy and complex quotation processes.
  • Strict policy conditions, particularly mandatory weekly inspections or ‘draining down’ of water systems.
  • Exclusions for common risks such as burst pipes, theft or squatting.

These obstacles quite often make the cost of these policies disproportionate to the value of cover required. And importantly – swallow up precious time of their Solicitors who are often managing multiple estates at once.

John Morgan Partnership (JMP), property insurance specialists, have developed an unoccupied property insurance policy specifically with Executors and law firms in mind. Rather than adopting standard vacant property cover, this policy addresses the realities and challenges of probate.

First of all, it removes the need for mandatory weekly inspections. By removing this condition, the policy not only simplifies compliance but can save estates hundreds of pounds over the course of probate.

But the policy doesn’t reduce protection in exchange for flexibility.

The Prosperity team has gone from strength to strength in the last few years. And with more person-power, comes more capacity to network with our partners and clients across the UK. It’s been a busy Autumn so far – here’s everything the team have been up to.

APIL Clinical Negligence Conference 2025

On Thursday 2nd October, Ghazala and Mark attended the APIL Clinical Negligence Conference 2025 in Brighton. It was a day was filled with interesting sessions and learning events, followed up by a dinner/dance in the evening. Prosperity Insurance provides a range of comprehensive Clinical Negligence After the Event (ATE) policies, administered in a way that’s convenient and fast for law firms. The event was a great opportunity for our team to catch up with clients and firms in the industry.

Manchester Legal Walk

As well as networking, the team like to donate their time in aid of local good causes. Ghazala, Sana, and Natasha from our team joined the Manchester Legal Walk to support the Access to Justic Foundation. The charity is dedicated to increasing free legal support, democratising advice and representation for those who need it, here in the UK.

It was a chilly evening, with the route taking our team members past the front door of our very own offices. A huge thanks to the organisers and to colleagues from Deanscore Chambers who made the evening so enjoyable.

The Prosperity Evening Thames Cruise

As a thank you to our wonderful clients and partners, we arranged an extra special evening event. On Thursday 16th October our group boarded The Edwardian for a spectacular cruise up the River Thames. Over the course of four hours we took in the city’s sights, enjoyed nibbles and libations, and enjoyed each other’s company. The evening was punctuated with lively conversation as all forty attendees networked – a full house. A huge thank you to all who attended, and to Prosperity’s Head of Insurance and Business Development, Andrew Williams for arranging a stellar night for everyone.

PI Futures Conference 2025

The next conference attended, was the Claims/PI Futures Conference at the fantastic venue of Emirates Old Trafford on Wednesday 22nd October. Mark, David and Ghazala from our team were delighted to attend alongside firms, CMCs, and regulators. A day full of fascinating discussion around the future of personal injury against a turbulent backdrop.

Bristol Law Society Legal Awards Dinner

With a strong commitment to the legal community, it was a privilege for Prosperity Insurance to sponsor this year’s Community Impact Award at the prestigious Bristol Law Society Legal Awards Dinner on sixth November, which was attended by four hundred and twenty legal professionals. The category has a deep-rooted significance within the vibrant Bristol and Bath legal hub, celebrating its law firms making a genuine difference within the community.  Prosperity’s David Law had the honour of presenting this Award to the inspiring winners, Barcan+Kirby solicitors.  It would be remiss of us not to congratulate former Managing Partner Bill Willcocks, also of Barcan+Kirby, who was the recipient of the Bristol Law Society President’s Outstanding Achievement Award. We’d like to congratulate all the nominees and winners across all fourteen categories.

The Latest on Leasehold Reform – What Conveyancers Need to Know

The English Leasehold system has gone through some big changes in the last year – and there are more reforms on the way. With the Leasehold & Freehold Reform Act 2024 now law, this is to be expected – but the pace of change is slow. Some actions have been taken, whilst others are waiting for further regulation or facing legal challenges.

For conveyancers, this creates a tricky landscape. Clients want clear answers on their rights, but the mix of new rules and proposals brings the risk of unclear advice, disputes, and even claims. Here’s a roundup of what’s changed, what to look out for, and why indemnity insurance policies – like those we offer at Prosperity Insurance – are an effective safeguard.

What’s in place

The following changes have taken place in the last year, and are now in force:No more “two-year rule”

Leaseholders no longer have to own their property for two years before they can extend their lease or buy the freehold.

Wider Right to Manage (RTM)

Buildings with up to 50% commercial space can qualify for RTM (previously the limit was 25%). This makes RTM available to more properties within mixed-use blocks.

Lower costs for leaseholders

In many RTM claims, leaseholders no longer have to cover the freeholder’s legal costs.

Service charge transparency

New rules are starting to standardise service charge paperwork and make it easier for leaseholders to challenge unfair charges. Annual reports and clearer demands will be expected as part of this.

What’s still to come

There are also a few changes mentioned in the initial legislation that require further legislation before they can be passed. These include:

Lease extensions to 990 years

The promise of standard 990-year extensions with peppercorn ground rent is in the Act, but it won’t start until secondary legislation is passed.

End of “marriage value”

The plan to abolish the marriage value (the extra cost if a lease has under 80 years left) is being challenged in court. Timing and outcome are uncertain.

And as well as these, the following issues are currently under consultation to help inform any future legislation to be passed:

  • The regulation of managing agents.
  • The banning of new leasehold houses and flats.
  • Reviving commonhold.

The importance of indemnity policies

“With the complex landscape of legislative change underway, clients and their solicitors need a quick and simple way to mitigate against the risks it presents. One such way is through taking out indemnity insurance. Even with reforms underway, disputes over service charges, RTM claims, or ground rent liabilities can surface unexpectedly – particularly when legislation is only partly in force or still under challenge.

Indemnity policies provide a safety net, protecting both clients and their advisers from the financial and legal fallout of these risks. Until the reforms settle into clear, consistent practice, indemnity cover remains a valuable tool to give clients greater confidence in their transactions.”

Prosperity Insurance launches another raft of new Conveyancing Indemnities

Prosperity Insurance is delighted to announce the introduction of a further 11 policies to its range of conveyancing indemnities. The move comes in response to increased demand from our clients for a wider range of policy coverage and takes our range to a total of 75 covering residential, commercial, and new build.

What’s being introduced

The new policies offered include what’s known as a ‘Section 38 Adoption of Road’ policy, which offers protection in the event of a shortfall arising in the outstanding mortgage. This could be caused by the relevant statutory authority demanding a contribution towards the cost of adopting a roadway because an S38 agreement has not been entered into, or where the developer has not fully complied to the agreement’s obligations.

They also include a ‘Section 104 Adoption of Sewer’ policy, which offers similar protection in the case of any statutory body demanding costs for adoption of neighbouring sewers.

The art of conveyancing

Both of these policies have been frequently requested by our client firms – and we’ve introduced them to ensure that we’re delivering in a way that responds to the needs of the conveyancing industry.

Our initial range of conveyancing indemnities included 22 separate policies, and it quickly became clear that there was appetite for more. We understand that Conveyancing – and even Commercial Property to a degree – often requires speed, and indemnities allow Solicitors to deliver that speed by putting appropriate protections in place for issues that are too time consuming or difficult to resolve.

Understanding the nature of property work has also informed the way we provide our policies. All of our competitively priced indemnities are managed through a simple to use portal which, once a firm is registered, can provide you with a premium in seconds and a policy in minutes. We’ve streamlined the process to require minimal reporting requirements, and everything is overseen by a dedicated Account Manager – any issues and we’re right on hand to support. All of the above to ensure your time and effort is free to be put into doing what you do best.

Executor Liability Insurance – all you need to know for protection in probate

The rise in contentious probate claims is well documented, particularly claims regarding a Will’s Validity, Financial Provision, and Estate Administration claims. With Will Validity claims, there is no limitation period to make a claim, whereas with Financial Provision claims, a claim should be made within 6 months from the date of the Grant of Probate/Letters of Administration. Last year, the Guardian reported a piece of research that suggested as many as 10,000 probate disputes were being raised each year, with the number being settled in court, also increasing. Prosperity’s Probate Indemnity Insurance policy helps to protect the Executor – and the estate in question – against the costs associated with defending such a claim. This, in turn, offers peace of mind for the Executor and all beneficiaries of the estate.

The solicitor’s role

As a Before the Event insurance, the probate solicitor’s role is especially important. In your client’s case notes specifically if there is a Will file, there can often be signs that a claim might be made. For example, complex familial setups or where there are estranged family members could be more likely to result in a dispute. In these cases, it might be sensible for you to put an Executor Liability Insurance policy in place. This will protect your client (and ensure prompt payment of your associated fees) in the case of a claim being raised.

The policy is only suitable for purchase for estates where there has been no express statement of intent to raise a claim. Therefore, getting ahead and putting the policy in place as early as possible in the probate process, is vital.

For firms, there is also an additional benefit of timely payment. Our probate insurance policies regularly pay out associated legal fees quicker than the estate in question, helping with cash flow and accelerating the payment process.

What does the policy cover?

Our Executor Liability Insurance covers the legal fees and other costs like mediation fees and court fees, associated with defending a claim against an estate. The policy covers claims made by a variety of entities, including third parties, charities, and constructive trust, and in certain cases protects against claims made after the estate has been distributed.

We also offer the option to defer payment for up to six months – a feature that we understand to be especially beneficial to clients.

ATE insurance to be included in initial conversations between client and solicitor

The Law Society has announced it will update its practice note on client information requirements, after it found that only 25% of solicitors verbally discussed Legal Expenses Insurance (including After the Event insurance) in initial conversations with clients. The updated guidance by the Legal Ombudsman will detail explicit mention of these insurances as potential funding options, if their legal case has merit.

At Prosperity Insurance, we’re working closely with firms that use our products to better help them explain policies to clients. Here are the key points that clients (and firms) should be aware of:

Protection

A comprehensive ATE policy offers protection against adverse costs, mainly your client’s liability for the other party’s costs, should your client lose the case.

Affordability

For many, an ATE insurance policy makes the pursuit of their case affordable, since the policy covers their solicitor’s costs in pursuing the case. With Prosperity’s ATE policies, all premiums are deferred and self-insured, meaning that the premium isn’t due until (and only payable if) the case wins. If the case loses, clients don’t pay the premium; instead, the Solicitor will claim on the policy on their behalf.

Put simply, this allows clients to pursue their case with minimal jeopardy.

Client confidence

Pursuing a case, even where it has merit, can be an intimidating thought for those who have never experienced a legal dispute. Having the security and protection of an insurance policy can often give clients the confidence they need to appoint a solicitor to represent them and pursue their case.

Access to justice

All of the above contribute to a bigger picture – widening access to justice. By removing financial barriers to pursuing a case, more people can access justice, leading to a fairer and more equitable legal landscape for all.

Investing in new talent – Prosperity welcomes Paralegal, Natasha Manoli

At Prosperity Insurance, we have a great deal of pride in our team. Our people are the driving force behind our product offering, our service, and the success of our business. Our team delivers in such a way, because we’re always welcoming new expertise and perspectives into that team, and our latest addition is Natasha Manoli who joins us as a Paralegal. We spoke to Natasha about her new role, her aspirations for the future, and her many, many hobbies!

How did you come to work in Insurance, Natasha?

My professional background thus far has been quite varied – and it all began with a part-time legal position whilst studying for my law degree. Between studying for my degree and the LPC I’ve held a number of Paralegal positions, and that’s given me exposure to different fields – some of which are going to be relevant to my role with Prosperity! I’ve worked across Court of Protection, Public Law & Human Rights, and Wills and Probate, but the move to insurance is something new for me. I love a fresh challenge so I’m looking forward to getting stuck in.

What are you most looking forward to about your new role?

My role will entail quite an eclectic mix of work – which is ideal because I enjoy variety! I’m looking forward to getting a holistic view of the business and how insurance works, and the opportunity to work in a more litigious area – as insurance is!

I think the other element of my role I’m excited about, is the chance to grow with the business. Prosperity Insurance has grown in the last few years, the team are doing an incredible job of driving that success, and I very much want to be part of that journey. To play an important role in a smaller team, as opposed to be a tiny part of a mammoth organisation.

What will your day-to-day role look like?

As I mentioned, my role is a varied one. For certain tasks I’ll be an administrator, for some I’ll use my legal expertise, and for others I’ll have to practice solid and informed judgement. I’ll be working across the different sectors we specialise in, supporting the wider team – all of whom have been an absolute joy to work with.

Tell us a bit about your interests outside of work.

How much time have you got? I have so many hobbies and I’m adding new things to the list all the time! I love to paint, bake, hike, and camp. Recently I’ve become a crochet fanatic and have been teaching myself embroidery so I can create crochet purses and bags! Anything creative where you get to see the fruits of your labour at the end is ideal for me.

Another fun fact – I was a dancer for 17 years, starting at the age of three. Tap, jazz, contemporary, street, and ballet – I did it all!
